Terms of Service

1.1 By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms and policies referenced herein.

1.2 If you are using the Platform on behalf of a family, organisation, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to “you” shall include that entity.

1.3 If you do not agree to these Terms, you must not access or use the Platform. Continued use of the Platform after any modifications to these Terms constitutes acceptance of the modified Terms.

1.4 You must be at least 18 years of age to create an account on the Platform. Parents and legal guardians may manage health records for their minor children through their own account.

2.1 To use the Platform, you must register for an account by providing accurate, current, and complete information, including your full name, email address, phone number, and a secure password.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at security@sehatlocker.com if you suspect any unauthorised access to your account.

2.3 You may add family members to your account to manage their health records. You represent and warrant that you have the legal authority or consent to manage health records on behalf of each family member you add.

2.4 We reserve the right to suspend or terminate accounts that provide false or misleading registration information, or that are used in violation of these Terms.

2.5 You may not create multiple accounts for the same individual, share account credentials with unauthorised parties, or transfer your account to another person without our prior written consent.

3.1 The Platform is intended solely for the lawful storage, management, and sharing of personal and family health records. You agree to use the Platform only for its intended purpose and in compliance with all applicable laws and regulations.

3.2 You agree NOT to:

• Upload, store, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable;
• Upload health records or personal data belonging to individuals without their consent or legal authority to do so;
• Use the Platform to store any content unrelated to health and medical records;
• Attempt to gain unauthorised access to other users' accounts, data, or any part of the Platform's infrastructure;
• Use automated scripts, bots, crawlers, or scrapers to access or extract data from the Platform;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform;
• Interfere with or disrupt the integrity or performance of the Platform or its underlying systems;
• Use the Platform for any commercial purpose not expressly authorised by Sehat Locker;
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

3.3 We reserve the right to investigate and take appropriate action against any violation of this section, including removing content, suspending accounts, and reporting violations to law enforcement authorities.

4.1 Not Medical Advice. Sehat Locker is a health record storage and management platform. It is NOT a medical service, healthcare provider, or diagnostic tool. The Platform does not provide medical advice, diagnosis, or treatment recommendations.

4.2 AI-Generated Summaries. The Platform may generate AI-powered summaries, classifications, and insights from your health records. These AI-generated outputs are provided for informational and organisational purposes only and should NOT be relied upon as medical advice. Always consult a qualified healthcare professional for medical decisions.

4.3 Health Scores. Health scores and vitals analysis provided by the Platform are based on general health guidelines and your self-reported data. They are not a substitute for professional medical assessment and may not account for individual health conditions or circumstances.

4.4 Emergency Situations. The emergency QR code feature is designed to provide first responders with basic health information. However, Sehat Locker is not an emergency medical service. In case of a medical emergency, always call your local emergency services immediately.

4.5 Accuracy of Records. You are solely responsible for the accuracy and completeness of health records and data you upload to the Platform. Sehat Locker does not verify the medical accuracy of uploaded documents.

5.1 Platform Ownership. The Platform, including its design, code, algorithms, AI models, user interface, graphics, trademarks, logos, and all related intellectual property, is owned by Sehat Locker Pvt. Ltd. and is protected by Indian and international intellectual property laws.

5.2 Limited Licence. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial health record management purposes.

5.3 Your Content. You retain full ownership of all health records, documents, and data you upload to the Platform (“User Content”). By uploading User Content, you grant Sehat Locker a limited licence to store, process, and display your content solely for the purpose of providing the Platform's services to you.

5.4 Feedback. Any suggestions, feedback, or ideas you provide regarding the Platform may be used by us without any obligation to compensate you or maintain confidentiality.

6.1 Plans. Sehat Locker offers both free and paid subscription plans. The features, storage limits, and family member limits for each plan are described on our pricing page and may be updated from time to time.

6.2 Payment. Paid subscriptions are billed in advance on a monthly or annual basis, as selected at the time of purchase. All payments are processed through our authorised payment partners and are denominated in Indian Rupees (INR).

6.3 Auto-Renewal. Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You can manage your subscription and cancel auto-renewal through your account settings.

6.4 Refunds. Subscription fees are generally non-refundable. However, if you experience a significant service disruption attributable to Sehat Locker, you may request a pro-rata refund for the affected period by contacting our support team within 30 days of the disruption.

6.5 Price Changes. We may change our subscription prices from time to time. Any price changes will be communicated to you at least 30 days before they take effect. Price changes will apply to the next billing cycle after the effective date.

6.6 Free Plan Limitations. Users on the free plan may have limited storage capacity, restricted access to certain features, and fewer family member slots. We reserve the right to modify the features available under the free plan at any time.

7.1 Termination by You. You may terminate your account at any time through the account settings page or by contacting our support team. Upon termination, you may request an export of all your data before deletion.

7.2 Termination by Us. We may suspend or terminate your account at any time if: (a) you violate these Terms or any applicable law; (b) your account has been inactive for more than 24 consecutive months; (c) we are required to do so by law or regulation; or (d) we reasonably believe your account has been compromised.

7.3 Effect of Termination. Upon termination, your right to access the Platform immediately ceases. We will retain your data for 30 days following termination to allow you to request a data export. After this 30-day period, all your personal data and health records will be permanently deleted in accordance with our Privacy Policy.

7.4 Survival. Sections relating to intellectual property, limitation of liability, indemnification, dispute resolution, and governing law shall survive the termination of these Terms.

8.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEHAT LOCKER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, HEALTH OUTCOMES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.

8.2 Our total aggregate liability for any claims arising out of or relating to these Terms or the Platform shall not exceed the amount you have paid to Sehat Locker in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim, or One Thousand Indian Rupees (INR 1,000), whichever is greater.

8.3 Sehat Locker shall not be liable for any loss or damage arising from: (a) your failure to maintain the security of your account credentials; (b) any inaccuracy in health records or data you upload; (c) medical decisions made based on information stored on or generated by the Platform; (d) temporary unavailability of the Platform due to maintenance, updates, or circumstances beyond our reasonable control.

8.4 Force Majeure. We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, telecommunications failures, power outages, or cyberattacks.

9.1 You agree to indemnify, defend, and hold harmless Sehat Locker, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your infringement of any third-party rights; or (e) any content you upload to the Platform.

10.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles.

10.2 Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

10.3 Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief from any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or breach of confidentiality obligations.

11.1 Informal Resolution. Before initiating any formal dispute resolution, you agree to first contact us at legal@sehatlocker.com and attempt to resolve the dispute informally within 30 days.

11.2 Mediation. If the dispute cannot be resolved informally, both parties agree to attempt to resolve it through mediation administered by a mutually agreed mediator in New Delhi, India, before pursuing arbitration or litigation.

11.3 Arbitration. If mediation is unsuccessful, any dispute shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, seated in New Delhi, India, and conducted in the English language.

11.4 Class Action Waiver. To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

12.1 We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes, we will update the “Last updated” date at the top of this page and provide reasonable notice through the Platform.

12.2 For material changes that significantly affect your rights or obligations, we will notify you through email or a prominent notice on the Platform at least 30 days before the changes take effect.

12.3 Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of the Platform and may request account termination.

13.1 Entire Agreement. These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Sehat Locker regarding the Platform.

13.2 Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

13.3 Waiver. Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or the right to enforce it at a later time.

13.4 Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

13.5 Notices. All notices to you will be sent to the email address associated with your account. Notices to us should be sent to legal@sehatlocker.com.
